Obtaining Car Accident Reports
Collision Report, Auto Accident Report, Police Report, CHP Report
The first page of the accident report identifies the parties that were involved. There will be data regarding the name, address, phone number and insurance information of each party as well as license and vehicle information. There may also be information about the damage to each vehicle, where the officer shades the areas of damage on a diagram of a vehicle.
Another page of the collision report will have information about the weather, surface conditions, whether cell phones were in use and other details relating to the collision.
Next, the officer will usually write a narrative about the collision. Here the officer will include facts about the scene, any statements made by the parties involved and witnesses and then the officer will give his opinion as to the cause of the accident.
Although police records are not admissible in court, they can be very useful in personal injury settlement negotiations and gathering witness information etc. Since a collision report did not personally observe the accident, cannot testify and be cross examined, it is inadmissible as “hearsay”. In trial, you can bring witnesses such as an officer to testify to what they saw if it is relevant.
How to obtain a collision report
First, determine what law enforcement agency responded to the scene. It can usually be either the California Highway Patrol (Freeways and highways), County Sheriff Departments (many cities outsource to county sheriff departments) and individual city police departments.
